These Terms of Service ("Terms") govern your access to and use of the online store at https://shop.gorillanetting.com (the "Store") operated by Gorilla Netting & Equipment LLC ("GNEQ," "we," "us," or "our").

Important entity note. This Store is operated by Gorilla Netting & Equipment LLC. It is not operated by Gorilla Netting LLC (the installation/services company). For installation and field services, visit https://www.gorillanetting.com.

By accessing or using the Store, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Store.

1. Eligibility and Accounts

  1. You must be able to form a binding contract under applicable law (generally 18+ in the U.S.) to place an order.
  2. If you order on behalf of an organization, you represent that you are authorized to bind that organization.
  3. You are responsible for account credentials and for activity under your account. Notify us promptly of unauthorized use.

2. Products, Descriptions, and Pricing

  1. We sell sports netting, turf-related goods, training equipment, mounds/mats, and related hardgoods. Product availability, specifications, images, and lead times may change.
  2. We strive for accuracy but do not warrant that descriptions, colors, weights, dimensions, or inventory displays are error-free. We may correct errors and cancel or refuse orders affected by obvious pricing or availability mistakes.
  3. Prices are shown in U.S. dollars unless stated otherwise and may exclude taxes and shipping until calculated at checkout.
  4. Some items are made-to-order, cut-to-order, or special-order. Those items may have longer lead times and limited cancellation/return rights (see our Shipping Policy and Refund & Returns Policy).

3. Orders and Acceptance

  1. Submitting an order is an offer to buy. We may accept, reject, or cancel an order (or part of an order) for reasons including suspected fraud, payment failure, stock/production issues, shipping restrictions, or pricing errors.
  2. Order confirmation emails acknowledge receipt; they do not always mean the order is fully accepted until payment clears and we (or our fulfillment partners) begin processing.
  3. We may contact you to confirm details, adjust freight quotes, or resolve address issues before processing.

4. Payment

  1. Payment is due as presented at checkout through our payment processors (via Shopify or other processors we enable).
  2. You authorize charges for products, taxes, shipping, and any agreed adjustments (including corrected freight quotes you approve before we process).
  3. We do not store full payment-card numbers on our own servers; card data is handled by payment processors.

5. Shipping, Risk of Loss, and Title

  1. Shipping methods, lead times, freight rules, and destination restrictions are described in our Shipping Policy.
  2. Title and risk of loss generally pass when the carrier accepts the shipment, except where law requires otherwise or we expressly state differently for a product class.
  3. You are responsible for providing accurate shipping information and for receiving/unloading freight deliveries as described in the Shipping Policy.

6. Returns, Refunds, and Cancellations

Returns, refunds, restocking fees, RMA requirements, custom-product rules, and cancellations are governed by our Refund & Returns Policy. Those rules are incorporated into these Terms by reference.

7. Warranties and "As Is" Disclaimer

  1. Manufacturer warranties. Many products may carry a limited manufacturer warranty. Coverage varies by product. See our Warranty page and the applicable product page.
  2. Retailer disclaimer. Except for (a) any express written warranty we specifically state for a product, and (b) non-waivable warranties required by law, products and the Store are provided "AS IS" and "AS AVAILABLE."
  3. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  4. Used / clearance goods, when offered, are sold as-is unless a product page expressly states otherwise.
  5. Nothing in these Terms limits non-waivable consumer rights under applicable law.

8. Installation and Services Cross-Link

Product purchase from this Store does not automatically include professional installation. For installation and related services, contact Gorilla Netting LLC at https://www.gorillanetting.com. Service proposals and contracts with Gorilla Netting LLC are separate from these Store Terms.

9. Acceptable Use

You agree not to:

  1. Use the Store for unlawful purposes or to violate others' rights;
  2. Attempt to disrupt, scrape at abusive scale, reverse engineer, or bypass Store security;
  3. Submit malware, spam, or deceptive content;
  4. Impersonate others or misuse another person's payment method; or
  5. Use the Store in a way that imposes unreasonable load on our infrastructure.

We may suspend or terminate access for violations.

10. Intellectual Property

Store content (text, graphics, logos, product photography we publish, layout, and software interfaces) is owned by GNEQ or our licensors and protected by intellectual-property laws. You may not copy or reuse Store content for commercial purposes without prior written permission, except for ordinary shopping and fair-use rights allowed by law. Product brand names of goods we sell remain the property of their respective owners.

11. Limitation of Liability

To the fullest extent permitted by law:

  1. GNEQ is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising from the Store or products, even if advised of the possibility.
  2. Our total liability arising out of any order or these Terms is limited to the amount you paid to GNEQ for the product(s) giving rise to the claim in the twelve (12) months before the claim.
  3. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted.

12. Indemnity

You agree to defend and indemnify GNEQ and its officers, members, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Store, your breach of these Terms, or your violation of law or third-party rights—except to the extent caused by our willful misconduct.

13. Governing Law and Disputes

  1. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
  2. Exclusive venue for disputes arising from these Terms or the Store shall be state or federal courts located in Florida, and you consent to personal jurisdiction there—except where applicable law gives you a non-waivable right to a different venue (e.g., certain consumer rules).

14. Privacy

Our collection and use of personal information is described in our Privacy Policy.

15. Electronic Communications

You consent to receive electronic communications related to your orders and account (transactional messages). Marketing messages are sent only where permitted; you may unsubscribe as provided in those messages.

16. Changes

We may update these Terms by posting a revised version on the Store with an updated effective date. Material changes apply prospectively. Continued use after posting constitutes acceptance, except where law requires additional consent. For pending orders, the Terms in effect when you placed the order generally apply, subject to mandatory law.

17. Severability and Entire Agreement

If a provision is unenforceable, the remainder stays in effect. These Terms, together with the Privacy Policy, Shipping Policy, Refund & Returns Policy, Warranty page, and any order-specific terms we present at checkout or on a product page, are the entire agreement regarding the Store between you and GNEQ, superseding prior conflicting Store website terms. They do not amend separate written contracts you may have with Gorilla Netting LLC for installation services.
